The Terms and Conditions for the use of the website and/or the “Jamore” software application are made between Jamour Corporation Limited, Jamour (Thailand) Company Limited and Biosoft Corporation Limited, including business partners, hereinafter referred to as (“Jamour” or the “Service Provider”), of the one part, and the user of the “Service”, being the website and/or the “Jamore” software application (the “User or Data Provider”), of the other part.

However, once the “User or Data Provider” has used the service of the website and/or the “Jamore” software application, the “User or Data Provider” shall be deemed to have thoroughly read and understood the Terms and Conditions for the use of the website and/or the “Jamore” software application. Use of the Service constitutes an expression of intention to agree to and to accept the Terms and Conditions for the use of the website and/or the “Jamore” software application in all respects.

Definitions

  1. “Jamour” or the “Service Provider” means Jamour Corporation Limited, Jamour (Thailand) Company Limited and Biosoft Corporation Limited, including business partners.
  2. “User or Data Provider” means a natural person or a juristic person who uses any service of “Jamour” or the “Service Provider”.
  3. “Service” means the use of the products, goods, software and applications of “Jamour” or the “Service Provider”. Products, goods, software applications and services mean:
    • Jamore, the organisational management program “Jamore”;
    • the J@time time recorder, and the J@scan fingerprint scanner for system access and time recording;
    • the J@dore personnel data and payroll processing service;
    • the J@done customer consultation, assistance and support service, etc.

Terms of Service of “Jamour” or the “Service Provider”

Terms

  1. “Jamour” or the “Service Provider” shall provide services to users under the terms and the service policy specified in this document, hereinafter referred to as the “General Terms”, and under the agreement for the use of the “Service”, hereinafter referred to as the “Specific Terms” as additionally prescribed.
  2. The “User or Data Provider” may acknowledge the General Terms and the Specific Terms by accessing them through the services of “Jamour” or the “Service Provider”.
  3. The General Terms and the Specific Terms, hereinafter collectively referred to as the “Terms”, are material to the provision of services by “Jamour” or the “Service Provider”. The “User or Data Provider” has a duty to read these Terms in detail so as to understand them, and the Terms shall be legally binding between the “User or Data Provider” and “Jamour” or the “Service Provider”.
  4. For a “Service” that has Specific Terms, in the event that the General Terms contain wording that conflicts with those Specific Terms, the wording of the Specific Terms shall apply to that service in place of the General Terms.
  5. The right to amend and supplement the Terms is reserved, without prior written notice to the “User or Data Provider”.

Acceptance of the Terms

  1. The “User or Data Provider” must acknowledge and accept the Terms; otherwise, the “User or Data Provider” will not be able to use the Service.
  2. The “User or Data Provider” impliedly acknowledges and accepts the terms of service of “Jamour” or the “Service Provider” from the commencement of the use of the Service onwards.
  3. The “User or Data Provider” shall not enter the names of other persons into the system, or impersonate other persons, without the consent of such persons. The “User or Data Provider” must first arrange for the consenting person to acknowledge and accept these Terms before the name may be entered into “Jamore”. In this regard, where the “User or Data Provider” enters the name of a consenting person into “Jamore”, “Jamour” or the “Service Provider” shall deem that the “User or Data Provider” has warranted that it has arranged for the consenting person to acknowledge and accept these Terms, and the “User or Data Provider” has impliedly agreed to be liable for the damage arising as a consequence of the failure to acknowledge or to accept these Terms.
  4. The “User or Data Provider” should record or make a copy of the General Terms as evidence.

Provision of Services by “Jamour” or the “Service Provider”

  1. “Jamour” or the “Service Provider” may develop or improve the form and the characteristics of the “Service” in order to deliver the best possible experience to the “User or Data Provider”, without prior notice to the “User or Data Provider”.
  2. “Jamour” or the “Service Provider” may suspend the provision of the Service temporarily or permanently, or terminate the provision of the Service to any particular “User or Data Provider”, if such provision of the Service affects other “Users or Data Providers” or conflicts with the law, without prior notice to the “User or Data Provider”, and shall notify the “User or Data Provider” after taking such action within 7 days.
  3. Upon the suspension or the termination of the Service, the “User or Data Provider” will not be able to access the Service, or to access the details of the account of the “User or Data Provider”, any document files, or other content contained in the account of the “User or Data Provider”.
  4. “Jamour” or the “Service Provider” may determine the maximum limit of the volume of data that the “User or Data Provider” may send or receive through the Service, or the amount of storage space used for any service, at any time, subject to the discretion of “Jamour” or the “Service Provider”, except in the case where it has been agreed in writing with “Jamour” or the “Service Provider”.

Use of the Service by the “User or Data Provider”

  1. The “User or Data Provider” shall provide information about itself, such as identification information or contact details that are accurate, true and always up to date, to “Jamour” or the “Service Provider”, as part of the process of registering to use the Service or of the continued use of the Service if so requested.
  2. The “User or Data Provider” shall use this Service for the purposes permitted under the agreement made with “Jamour” or the “Service Provider” and not in contravention of the laws, rules, regulations and practices that are generally accepted, which includes the entry into the system of the personal data of other “Users or Data Providers” without the consent of the owner of the personal data.
  3. The “User or Data Provider” shall not access, use, or attempt to access any service by any means other than the channels provided by “Jamour” or the “Service Provider”, unless the “User or Data Provider” has been expressly permitted by “Jamour” or the “Service Provider” to do so.
  4. The “User or Data Provider” shall not do, or take part in, any act obstructing or interfering with the services of “Jamour” or the “Service Provider”, including the servers and the networks connected to the Service.
  5. The “User or Data Provider” shall not duplicate, copy, reproduce, sell, exchange or resell the Service for any purpose in a manner that may unfairly affect the rights of other “Users or Data Providers”, whether directly or indirectly, unless the “User or Data Provider” has been expressly permitted by “Jamour” or the “Service Provider” to do so.
  6. The “User or Data Provider” shall be solely liable to any person for the damage arising from a breach of the Terms.

Passwords and Account Security

  1. In the creation of a user account for use for various purposes, the user has the duty to maintain the confidentiality of the password linked to any account used to access the Service, and shall be solely liable to “Jamour” or the “Service Provider” for all use occurring under the account of the “User or Data Provider”.

Protection of Privacy and the Personal Data of the “User or Data Provider”

  1. “Jamour” or the “Service Provider” shall treat the personal data and protect the privacy of the “User or Data Provider” under the privacy policy of “Jamour” or the “Service Provider”.
  2. In the case where such personal data is processed by a data processor under the responsibility of “Jamour” or the “Service Provider”, “Jamour” or the “Service Provider” shall ensure that such data processor carries out the processing in accordance with the privacy policy of “Jamour” or the “Service Provider” likewise.

Content in the Service

  1. The “User or Data Provider” may receive, access, create, send or display data, such as data files, written text, computer software, music, audio files or other sounds, photographs, videos or other images, as part of the Service or through the use of the Service, hereinafter referred to as the “Content”.
  2. The Content presented to the “User or Data Provider” may be protected by the intellectual property rights of the owner of that Content. The “User or Data Provider” has no right to alter, modify, sell, distribute, transfer, or create derivative works on the basis of such Content, whether in whole or in part, unless the “User or Data Provider” has obtained the express permission of the owner of that Content, or has such right lawfully.
  3. “Jamour” or the “Service Provider” reserves the right to screen, review, mark, alter, modify, refuse or delete any inappropriate Content from the “Service”, and “Jamour” or the “Service Provider” may clearly provide tools for the screening of Content, without contravening the relevant laws, rules and regulations of the authorities.
  4. “Jamour” or the “Service Provider” shall not be liable to any person for the loss or the damage arising from the items of Content created by the “User or Data Provider”, whereby the “User or Data Provider” of such items of Content shall be solely liable.
  5. If the “User or Data Provider” has created, sent or displayed any Content in the “Service” to another person, the “User or Data Provider” shall be solely liable to any person for any loss or damage arising from any act done in relation to such Content, including to “Jamour” or the “Service Provider”.

Ownership and Intellectual Property Rights

  1. “Jamour” or the “Service Provider”, or the licensors of “Jamour” or the “Service Provider”, are solely entitled by law to the ownership and to all of the benefits, including any intellectual property rights, existing in the Service which “Jamour” or the “Service Provider”, or the licensors of “Jamour” or the “Service Provider”, have created, whether or not those rights have been registered.
  2. The “User or Data Provider” shall not disclose the information that “Jamour” or the “Service Provider” has designated as confidential, without the prior written consent of “Jamour” or the “Service Provider”.
  3. The “User or Data Provider” shall not use the trade name, trademarks, service marks, logos or domain names of “Jamour” or the “Service Provider”, without the written consent of “Jamour” or the “Service Provider”.
